       For offenses that are not allowed to be settled by the Settlement Committee under Section 317 of the Securities and Exchange Act B.E. 2535 (1992), Section 42 of the Provident Fund Act B.E. 2530 (1987), Section 43 of the Royal Enactment on Special Purpose Juristic Persons for Securitisation B.E. 2540 (1997), Section 155 of the Derivatives Act B.E. 2546 (2003), or Section 94 of the Trust for Transactions in Capital Market Act B.E. 2550 (2007), or those that alleged offenders refuse to settle their cases with the Settlement Committee, the Office of SEC shall file criminal complaints to an inquiry official of the Economic Crime Division of the Royal Thai Police or to a special case inquiry official of the Department of Special Investigation for further investigation according to the Criminal Procedure Code. The criminal complaints are as follows:

Disclosure Policy

       Information shall be maintained on this website for ten calendar years from the date of complaint filing or for six months from the date that the case is deemed final depending on which period is longer. Information earlier than the year 2008 is disclosed in the original Thai version and will be available in English on written request to the Litigation Department of the Office of SEC, 14th Fl., GPF Witthayu Towers, 93/1 Wireless Road, Lumpini, Patumwan, Bangkok 10330, Thailand. In case (1) the court render a final judgment of acquittal, (2) the public prosecutor issues a non-prosecution order, or (3) the right to begin criminal proceedings is terminated, the status of the case shall be updated and disclosed on the website for six months.
